These Terms of use and Service include all important information regarding legal rights, obligations and resources. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. If you disagree with any part of the Terms then you may not access the Service.

1. Our Service

The company: Abroadwith.com is a service offered by Abroadwith UG (hereinafter: “We,” “Our,” “Abroadwith,” “our website,” “the website” or “platform”) located in Weserstrasse 14, Berlin – Germany; e-mail: support@abroadwith.com; phone: +49 1758159356. Abroadwith UG is registered as a private limited liability company at the Amtsgericht Charlottenburg – Handelsregister (Commercial register Berlin) under the number: HRB 168417.

Abroadwith is a one stop platform for language and cultural exchange. We connect immersion hosts and language schools with international students looking for an immersion programme and/or language course abroad.

Immersion hosts must understand how laws work in their respective cities or towns. It is imperative that immersion hosts review these local laws regarding length of stay and any other specific laws concerning international homestays. In the case of educators it is imperative that they review these local laws specific laws concerning language education.

Abroadwith is a platform through which cultural immersion and language exchange is facilitated by allowing immersion hosts and language schools offer their services to students. These services are booked directly by students interested in the services provided by hosts and language schools on the platform. We are not a third party taking part in the agreements between students, immersion hosts and language schools. We are not an agency, and we do not control the conduct of different parties in such agreements (students, immersion hosts and language schools). Abroadwith disclaims all liability in this regard to the maximum extent permitted by law.

When using our website to access these services, whether or not you become a registered user, you are agreeing to comply with our terms and conditions, as well as our privacy policy, in a legally binding nature.

These Terms refer to your use and access of our website, services and content constituting a binding legal agreement between Abroadwith and yourself.

As a user you have no right to obtain information or services from the website, nor can you continue using the website in any regard, if you disagree to the above Terms. In the case of using this website in disagreement with our Terms, you may be subjected to civil and/or criminal penalties.

Important terms:

Content: the textual and visual components that make up the Abroadwith website.

Users: a visitor of the Abroadwith website of whom not necessarily registers to become a registered user.

Abroadwith: an open community marketplace for language learning and cultural immersion where students, immersion hosts, and educators can connect for transactional business.

Immersion request period: the allotted time of 48 hours an immersion host has to accept or decline a student’s request to stay at the immersion host’s household for selected immersion program.

Language request period: the allotted time of 72 hours an educator has to accept or decline a student’s request to attend selected language course.

Student: a person that partakes in any one of the immersion programmes. He or she may also choose to select a language course in addition to the chosen immersion program. Adding a language course is not mandatory, although highly recommended to master the desired new language.

Immersion host: a person that houses a student in his or her home for any duration of time in the chosen immersion program.

Immersion program: a specific arrangement (one of three options), in which an immersion host accommodates a student in the home.

Stay: a standard family or apartment homestay where the immersion host provides accommodation, breakfast, and a minimum of seven hours per week to better immerse the student in the local culture and language.

Tandem: a typical family or apartment homestay where two languages are exchanged in the home. The host provides accommodation, breakfast, and a minimum of seven hours per week divided between both languages to immerse equally in the tandem cultures and languages.

Teacher Stay: a typical family or apartment homestay in a certified teacher’s home where the host provides accommodation, breakfast, a minimum of five hours of language teaching, plus additional daily shared time to better immerse the student in the local culture and language. In order to qualify for this program, the host must provide Abroadwith with enough evidence of his or her teaching certifications and experience.

Educator: any entity or person that provides language teaching as a service outside of an immersion programme (not to be confused with teacher’s stay).

Home: an immersion host’s household where a student stays as part of his or her immersion program.

Member/Registered user: a visitor who signs up through the registration process, who at will, openly and freely uses the Abroadwith platform.

Member content: the textual and visual components a member/registered user uploads to his or her personal profile on the Abroadwith platform.

Abroadwith transaction fee: a charge assessed for assisting in the immersion programme bookings.

Abroadwith’s service fee: a charge assessed to a booking for Abroadwith’s platform assisting in the outcome of successful exchange between students, immersion hosts, and educators alike.

Currency exchange fee: the cost of exchanging one currency for another in the booking process.

Fees: all charges that may apply (Abroadwith transaction fee, Abroadwith’s service fee and Currency exchange fee).

Taxes: an additional and compulsory contribution fee dependent of country governmental regulations in regards to the cost of services and transactions.

The website and services offered by Abroadwith are intended solely for persons who are 18 years of age or older. Any access to or use by anyone under the age of 18 is prohibited. By accessing or using our platform you hereby represent and warrant that you are at least 18 years old.


Abroadwith may at any time modify or amend these terms and conditions effective for the immediate future. Abroadwith is not obliged to give users prior notice of any amendment taking effect. It is the responsibility of the users to remain up to date with these Terms and Conditions.

2. Binding Agreement

Abroadwith is a platform through which cultural immersion and language exchange is facilitated by allowing immersion hosts and language schools offer up their services. These services are booked directly by the students from the immersion hosts and educators on the platform. We act as the interface between the immersion hosts, educators and students.

Students enter into a contract, when they send an immersion booking request. Immersion hosts and educators enter into a contract, when they confirm a booking request. The terms, conditions and obligations of this contract are specified below:

The student discloses what kind of immersion option he/she is requesting, including the duration of the immersion, the type of immersion program, details concerning the immersion option and services requested at home to the immersion host. The student must abide by the price disclosed publicly set forth by the immersion host, as well as Abroadwith’s Service fee.

Additionally, the student may book a language course from a language school or a language tutor (educators) in proximity to their host's home. In this case, the student lets the educator know what kind of language course option he/she is requesting, including the duration of the course, course schedule and level. The student must abide by the price disclosed publicly by the educators, as well as Abroadwith's fees.

The contract between students and immersion host does not go into effect, if the immersion hosts denies the request during the confirmation period, which is within the first 48 hours after a booking request is made. Additionally, the contract does not go into effect, if the immersion hosts fails to respond to the request during the confirmation period. In such case as this, the request is automatically denied.

The contract between students and educators does not go into effect, if the educator denies the request during the confirmation period, which is within in the first 72 hours after a booking request is made. Additionally the contract does not go into effect, if the educator fails to respond to the request during the confirmation period. In such case as this, the request is automatically denied.

If the immersion hosts confirms the request, then the immersion programme becomes payable as agreed upon previously. Language courses offered by educators are only payable after the immersion programme has been confirmed by the host.

The contract between immersion hosts and educators with students is established the moment an immersion booking and/or language course request is/are confirmed. Language course request can only be confirmed by the educator once immersion has been approved by the immersion host.

This acceptance of a booking request entails a binding declaration by immersion hosts and educators to provide a service as specified on the immersion programme and language course request respectively. Including, but not limited to:

1) In the case of the immersion program, the immersion option, duration of the immersion, accommodation details, details concerning the immersion option, services requested at home, pricing of the service.

2) In the case of the educators, the duration of the course, course content, schedule, level and pricing of the course.

3. Use of Abroadwith.com

Users are not allowed to use the website and related services in any way that damages or harms Abroadwith or its third parties.

Every user is responsible for managing and controlling their account’s credentials, and uses such credentials in good faith. It is not permitted to disclose account credentials to any other party. If a situation arises, and you suspect that someone might have access to your credentials, please notify us immediately at support@abroadwith.com.

Users are not permitted to use the website in noncompliance with any law or regulation, nor to infringe intellectual property rights.

In the case of stoppage of our services, Abroadwith will notify all users within reasonable time. Abroadwith is entitled to end our services including our website, app and others without being liable to indemnify or compensate for damages.

4. Abroadwith's Rights

In providing you with access to our website, Abroadwith reserves the following rights. And in accessing, browsing or otherwise using our services you grant to Abroadwith, as well as agree that Abroadwith shall have the following rights:

  • Abroadwith has the right to refuse access to our platform without prior notice. Additionally, Abroadwith has the right to suspend, amend or disable your account without giving notice or reason.
  • Abroadwith has the right to update the fees, website and billing methods without prior notice.
  • Abroadwith has the right to access any or all of your account in order to respond to your requests for technical support so long as we maintain appropriate administrative physical and technical safeguards for the protection of the security, confidentiality and integrity of your data.
  • Abroadwith has the right to access and use your data for executing and handling the services, payments and payouts inherent to our platform.
  • Abroadwith has the right to report you to the police or relevant local authorities should we, at our sole discretion, believe that your behaviour or conduct is unlawful.
  • Abroadwith has the right to update these terms and conditions at anytime.

5. Rights and Obligations for Immersion Hosts

Immersion hosts homes must meet quality criteria. If this quality is not met, we reserve the right to reject the host's services from the platform.

Immersion options: Immersion host must know and agree with the requirements for each immersion programme they choose to offer:

Stay: standard family or apartment homestay. Host provides accommodation, breakfast and a minimum seven hours shared time per week with the student/s in order to immerse them in the local culture and language.

Tandem: family or apartment homestay with halved language exchange hours. Host provides accommodation, breakfast and a minimum seven hours shared time per week with the students to divide between both languages in order to immerse respectively in the tandem cultures and languages.

Teacher’s stay: family or apartment homestay with a certified teacher. Host provides accommodation, breakfast and a minimum five hours of language teaching, plus additional daily shared time with the students. In order to become a teacher on the platform, host must provide Abroadwith with enough evidence on his/her teaching certifications and experience.

Immersion hosts are responsible for the home listed on their accounts and the services offered, including but not limited to: room, home, amenities, descriptions, address, languages offered to be spoken in the home, menus and food options, cleaning, laundry, airport pickup, duration of the program, hours shared with the students, hours teaching language to the students (for teacher’s stay only).

Homes and their educators are verified via ID checkup, personal interview (Abroadwith verified) and address verification. These verification processes are not mandatory for all hosts, however Abroadwith recommends they be done as soon as possible to improve trust on one's service offering. We reserve the right to request formal proof of residence or identification from immersion hosts.

Professional photography services will be provided to immersion hosts in a selected number of cities at Abroadwith’s discretion. The copyright on these images belongs to Abroadwith, however immersion hosts are allowed to use them as long as they do so without removal of Abroadwith’s watermark and continue using the platform. Nonetheless, Abroadwith will accept non-profesional pictures and videos from immersion hosts and their homes as long as they meet our quality criteria.

Once your home is completed and published on www.abroadwith.com, students will be able to send you a request to book an immersion programme at your home. Within the first 48 hours (booking request period), you may accept or decline the request. When accepting the request on our platform, you are accepting the booking of the immersion programme selected by the student with all services and details you chose to offer. You enter a legally binding agreement with the student to provide these services as stated on your home page, for the price selected minus the transaction fee for using Abroadwith platform. The student will be sent a confirmation email immediately after your confirmation.

Students enter into a contract when sending an immersion booking request. The contract is entered by hosts and educators when confirming a immersion booking request. Immersion booking request period is 48 hours and the language course booking request period is 72 hours.

Abroadwith has the obligation to transfer the payout from the student for the immersion programme (minus transaction fee) at the beginning of the course within a commercially reasonable time (no longer than 1-2 weeks depending on the country and payout method) as specified in the section 9, payouts. When providing personal information and billing information about yourself, you must ensure that the provided information is lawful and correct.

Immersion hosts are responsible of not breaking agreements with any third parties such as homeowners associations, condominium, lease or rental agreements, and will be in compliance with all applicable local laws and tax regulations at the beginning of every immersion program.

Immersion hosts must have proper home insurance during all immersion programmes. It is the immersion host’s responsibility to check to what extent damages by a third party (students) are covered by their current home insurance. In no circumstance will Abroadwith take responsibility for personal or material damages by students or hosts. Abroadwith is in no way an insurance provider, nor responsible for third party damages other than damages undertaken directly by Abroadwith or Abroadwith’s employees.

International health insurance is solely the responsibility of the students. Students must check they are covered sufficiently under any health eventuality, when traveling abroad. Abroadwith and immersion hosts are not responsible in any way to cover expenses arising from such circumstances.

6. Rights and Obligations for Educators

Educator language courses and facilities in the case of language schools must meet quality criteria. If this quality is not met, we reserve the right to reject the services.

Language course content: Educators must know and agree with the requirements for each course they create and choose to offer, including but not limited to: the duration of the course, course content, schedule, level and pricing of the course.

Educators are verified via ID checkup, personal interview (Abroadwith verified) and address verification. These verification processes are not mandatory for all educators, however Abroadwith recommends they be done as soon as possible to improve trust one's service offering. We reserve the right to request formal proof of residence or identification from educators.

Once your courses are completed and published on www.abroadwith.com students will be able to send a request to book a course.

Students enter into a contract when sending an immersion booking request. The contract is entered by hosts and educators when confirming an immersion booking request. Immersion booking request period is 48 hours and the language booking request is 72 hours.

Within the first 72 hours (booking request period) you may accept or decline the request. When accepting the request on our platform, you are accepting the booking of the course selected by the student with all services and details that you chose to offer when creating your course. You enter a legally binding agreement with the student to provide these services as stated on your courses’ page for the price selected minus the discount negotiated with Abroadwith for using Abroadwith platform. The student will be sent a confirmation email immediately after your confirmation.

Abroadwith has the obligation to transfer the payout from the student for the course (minus negotiated discount) at the beginning of the course within a commercially reasonable time (no longer than 1-2 weeks depending on the country and payout method) as specified in the section 9, payouts. When providing personal information and billing information about yourself, you must ensure that the provided information is lawful and correct.

Educators must have proper school facilities insurance or home insurance (in the case of tutors giving private lessons at home) during all courses. It is educator’s responsibility to check to what extent damages by a third party (students) are covered by their current school facilities insurance or current home insurance. In no circumstance, will Abroadwith take responsibility for personal or material damages by students or educators. Abroadwith is in no way an insurance provider, nor responsible for third party damages other than damages undertaken directly by Abroadwith or Abroadwith’s employees.

7. Rights and Obligations for Students

When providing personal information and billing information about yourself, you must ensure that the provided information is lawful and correct.

Immersion options: students must know about the services that each immersion programme offers when choosing to book on the platform:

Stay: standard family or apartment homestay. Host provides accommodation, breakfast and a minimum seven hours shared time per week with the students in order to immerse them in the local culture and language.

Tandem: family or apartment homestay with halved language exchange hours. Host provides accommodation, breakfast and a minimum seven hours shared time per week with the students to divide between both languages in order to immerse respectively in the tandem cultures and languages.

Teacher’s stay: family or apartment homestay with a certified teacher. Host provides accommodation, breakfast and a minimum five hours of language teaching, plus additional daily shared time with the students. In order to become a teacher on the platform, host must provide Abroadwith with enough evidence on his/her teaching certifications and experience.

Language course content: Students must know and agree with the offering for each course they choose to book as displayed on the platform: the duration of the course, course content, schedule, level and pricing of the course.

Students are verified via ID checkup. This verification is not mandatory for all students, however Abroadwith recommends this be done as soon as possible in order to improve trust on one's profile. We reserve the right to request formal proof of residence or identification from students.

Students enter into a contract when sending an immersion booking request. The contract is entered by hosts and educators when confirming an immersion booking request. Immersion booking request period is 48 hours and language course booking request is 72 hours.

Immediately after you send an immersion booking request, we pass the application on to the immersion host and educators. They can then confirm or decline your request in the above booking time windows.

When you click on “Request,” you are entering the contract. The amount to be billed after immersion host and/or educator has confirmed is preauthorised, including Abroadwith's service fee. You will receive an approval or denial email, as soon as the immersion host or educator answers your request. If the booking request period expires, you will also be notified through email of this fact.

If the immersion programme is declined, both immersion programme and language course are declined. Any preauthorised amount will be released and you have the option to request a different immersion programme on the platform.

If only the immersion programme is approved but the language course is declined you will be liable only for the immersion programme (including Abroadwith’s service fee), and have the option to request a different language course on the platform.

If both immersion programme and language course are approved you will be liable for both the immersion programme and language course (including Abroadwith’s service fee).

Immediately after confirmation by the immersion host and educator you will be charged for the immersion program, language course and Abroadwith's Service fee. Upon completion of your payment obligation, it is Abroadwith’s responsibility and obligation to remit the immersion programme and language courses costs minus Abroadwith’s service and transaction fees at the start of the immersion programme and language course to immersion hosts and educators respectively.

Immersion hosts must have proper home insurance during all immersion programmes. It is the immersion host’s responsibility to check to what extent damages by a third party (students) are covered by their current home insurance. In no circumstance, will Abroadwith take responsibility for personal or material damages by students or hosts. Abroadwith is in no way an insurance provider, nor responsible for third party damages other than damages undertaken directly by Abroadwith or Abroadwith’s employees.

International health insurance is solely the responsibility of the students. Students must check that they are covered sufficiently under any health eventuality, when traveling abroad. Abroadwith and immersion hosts are not responsible in any way to cover for expenses arising from such circumstances.

8. Payment Terms

General usage of Abroadwith’s platform is free of charge for students, immersion hosts and educators. Booking immersion programmes and language courses has a cost specified on the platform by immersion hosts and educators. Students are bound to pay for these services plus Abroadwith's service fee, and a currency exchange fee, if applicable. Immersion hosts are bound to pay a (3%-3.9%) transaction fee discounted from the service’s total price.

Students must pay the service’s total price plus all fees for using the platform upon booking an immersion programme and/or language course. The service fees together with the immersion programme and language course costs are payable to Abroadwith upon sending the immersion programme and language course booking request, but only executed after confirmation by host and/or educators.

Payment methods currently include and debit credit cards and paypal.

When using credit or debit cards students give Abroadwith the preauthorisation for the entire payment amount (immersion program, fees and optional language course). Abroadwith only executes and captures the authorised amount after the immersion program and language course has been accepted by immersion hosts and educators respectively. If the language course is not accepted but the immersion programme is, the student is only billed for the immersion programme and its related fees.

Payments may be made in Euros, USD or GBP. Other currencies might incur an extra currency exchange fee either by Abroadwith or your credit or debit card provider. We have no control on the currency exchange rates applied.

Abroadwith’s online platform facilitates transactions between students and immersion hosts and/or educators who may prefer to pay and to receive payments in different currencies. This may require foreign currency conversions to accommodate differing currency preferences. Although Abroadwith’s platform allows users to view the price of immersion programmes and language courses in a number of currencies, the currencies available for users to make and receive payments may be limited. This may not include the default currency in any given geographic location.

Students are responsible for accurately providing Abroadwith with required billing information such as full name, billing address and payment method information.

9. Payout Terms

Abroadwith deducts a (3%-3.9%) transaction fee from the offered immersion programme price that an immersion host provides in order to cover expenses incurred, when handling transactions and payments.

Payouts: Immersion programme and language course balance will be paid to immersion hosts and educators respectively upon the commencement of the programme within one week of the start date. For programmes or language courses longer than two months the payouts will be made recurrently as monthly installments.

Payout might experience delays depending on the receivers payout method and geographical location. Payouts will never be executed later than five days after an immersion programme or language course commences.

Payouts may be executed via wire transfer or Paypal, and paid out in Euros, USD or GBP. Other currencies might incur a currency exchange fee. We do not influence conversion rates in any way.

Banks might charge you for receiving transfers when your bank is located outside of the EU. Abroadwith is not responsible for these fees, as they might be charged to you solely by your bank.

Immersion hosts and educators are responsible for accurately providing Abroadwith with required billing information such as full name, billing address and payment method information.

10. Cancellation

Student has the right to withdraw before the service is fully executed, that is before the immersion and or language course has been approved. After approval standard withdrawal is no longer possible and cancelation can be requested before the start of the programme / language course incurring the penalties described below.

After immersion programme and/or language course have been approved by immersion hosts and/or educators any of the parties may cancel, including students. In such cases the following penalties apply:

1) Student Cancellation:

  • Standard (over 14 days before the immersion programme or language course begins). Students pay the assigned booking fees.
  • Short notice (less than 14 days to start date). Student is penalised with a fixed rate of 15% (including all fees).

2) Immersion Host Cancellation:

  • Standard (over 14 days before the immersion programme begins). Full refund, minus 3% transaction costs.
  • Short notice (less than 14 days to start date). Full refund, minus 3% transaction costs. Host is penalised with a fixed rate 10% deductible from their next booking.

3) Educator Cancellation:

  • Standard (over 14 days before the language course starts). Full refund, minus 3% transaction costs.
  • Short notice (less than 14 days to start date). Full refund, minus 3% transaction costs. Educator is penalised with a fixed rate 10% deductible from their next booking.

11. Home Rules and Arbitration

Home rules are defined by immersion hosts and must be followed by students in all cases, unless a home’s rule(s) enter in conflict with students rights on these terms and conditions. Home rules are specified by immersion hosts before sending immersion programme booking request.

In the case of disagreements between immersion hosts and students, each case will be analysed in accordance with these terms and conditions and on the basis of the facts of the individual case. Abroadwith will mediate to try to solve the issue within 48 hours. If there is no way to resolve the disputes, the immersion programme will end. Depending on the situation and after evaluating every case the student might be sent to a new family, a different accommodation or refunded with the pending immersion programme period balance. Immersion host must return any pending amount paid covering the period after the dispute.

IF A STUDENT AND A IMMERSION HOST OR AN EDUCATOR ENTER AN AGREEMENT OUTSIDE OF THE PLATFORM OR STOP USING OUR PLATFORM FOR EXECUTING THE PAYOUTS FOR THE SERVICES RECEIVED, ABROADWITH IS NOT LIABLE TO ARBITRATE IN ANY DISPUTES BETWEEN THESE USERS.

12. Taxes

You as an immersion host or educator understand and agree that you are solely responsible for determining (i) your applicable tax reporting requirements, and (ii) the taxes that should be Included, and for including taxes to be collected or obligations relating to applicable taxes arising from immersion programmes and language courses offered by you. You are also solely responsible for remitting to the relevant authority any taxes included or received by you. Abroadwith cannot and does not offer tax-related advice.

13. Limited Liability

Abroadwith is only liable for damages arising from willful, intentional or grossly negligent misconduct.These damages shall be limited to the maximum extent permitted by law.



YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE, APPLICATION, SERVICES AND WEBSITE CONTENT REMAINS WITH YOU. NEITHER ABROADWITH, NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE WEBSITE OR ITS CONTENT WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE WEBSITE, APPLICATION, SERVICES, WEBSITE CONTENT , OR FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE SITE, APPLICATION OR SERVICES OR OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE WEBSITE, APPLICATION OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ABROADWITH HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT WILL ABROADWITH AGGREGATES LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE WEBSITE, APPLICATION, SERVICES OR WEBSITE CONTENT EXCEED ONE HUNDRED DOLLARS ($100). THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN ABROADWITH AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Insofar as Abroadwith’s liability is limited according to these terms and conditions, this limitation shall also apply to the personal liability of directors, managers, employees and other agents of Abroadwith who are involved in the creation, production and management of the website.

Therefore, in no event shall Abroadwith UG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Abroadwith UG, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; or c) the results of using the Service will meet your requirements.
 We have no control over the conduct or behaviour of immersion hosts, educators, students and other persons using the website or any of the related services. Therefore we disclaim all liability in this regard to the maximum extent permitted by law. 
 You agree to indemnify and hold Abroadwith and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of your use of the platform or your violation of any law or the rights of any third party.

For the sake of clarity you hereby warrant that all data supplied by you to Abroadwith is valid and true. You will indemnify Abroadwith for all possible claims, howsoever arising, directly or indirectly and with or without fault on your part, from incorrect information supplied by you. 
 Abroadwith is fully liable for damages caused with intent or through gross negligence by Abroadwith, its employees or agents, for fraudulent concealment of defects.

14. Intellectual Property

All rights are vested in Abroadwith or its licensors, usage of this material is not allowed without prior permission. Permission can be requested by contacting us at support@abroadwith.com.

We respect the intellectual property rights of others, it is our policy to respond to any claim that content posted on the service infringes the copyright or other intellectual property infringement ("Infringement") of any person.

If you are a copyright owner, or authorised on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, you must submit your notice in writing to the attention of "Copyright Infringement" of support@abroadwith.com and include in your notice a detailed description of the alleged Infringement.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any content is infringing your copyright.

Trade names or registered trademarks remain vested in Abroadwith or their respective owners, whichever the case may be.

The intellectual property rights in material uploaded by users, remains vested in the user. User hereby grants Abroadwith a license to process the material in accordance with the agreed upon purpose. Pictures from our photographers might be used by the immersion hosts or educators as long as they are using the platform and the images have Abroadwith’s watermark.

We do our best to ensure the security of your personal information, however users acknowledge that they provide their personal information and user content at their own risk.

16. Transfer of Rights and Obligations

Abroadwith is entitled to transfer its rights and obligations pursuant to this Agreement to a third party. This is especially allowed in case of a transfer due to a change of legal entity, transfer of Abroadwith as a company or merger of Abroadwith. User hereby grants its permission therefor. A possible transfer is without prejudice to any rights (including the right of termination) of user under this agreement.


Without Abroadwith's prior express written permission, you are not allowed to transfer, assign, charge or deal in any manner the rights and obligations under the agreement to a third party. The permission can be subject to additional provisions.

17. Notice and Take Down

In case you breach the rights of third parties, these third parties have the right to request Abroadwith to modify or delete infringing links or material, and to provide them with your personal data (only limited to name and contact details), without being liable to compensate, nor to indemnify for damages. You hereby give Abroadwith permission to do so, if necessary. The user has to indemnify Abroadwith for any costs arising from the event.

18. Concluding Remarks

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

19. Jurisdiction

These Terms and Conditions are governed by the applicable laws of the Federal Republic of Germany, and they will be interpreted in accordance with German law. 


In case of conflict between the English original version of the terms and conditions and other languages the English version will prevail. You and we agree to submit submit to the personal and non-exclusive jurisdiction of the courts in Germany for resolving any dispute between the parties.
